Law School Tutor Big Law vs. Public Interest

You don’t have to join†¦but it can be hard not to. One of the biggest cultural divides at any top law school is likely to be the divide between the warm-hearted, caring public-interest law community, and the soulless, greedy, cold-hearted big-law-firm crowd. Or, it might be the divide between the naà ¯ve, holier-than-thou do-gooders and the realistic, well-trained, practical law-firm hires. It’s all a matter of perspective! At Harvard Law School, where I went, this was a constant source of conversation, discussion, tension, etc. There was a student group called Firmly Refuse, which pasted the school with fliers highlighting the malfeasant corporations which big law firms had represented, and a backlash to this group that seemed equally strong and impassioned. So, what gives? The Facts (or, My Experience) When I was looking into law schools, I remember law schools telling me ad nauseam about their public interest opportunities. I heard about clinics, summer funding programs, fellowships, you name it. From what I heard at the admitted students weekends, you’d think that all law schools did is pump out public defenders, legal services lawyers, human rights advocates, and government attorneys! Of course, the job placement statistics, at least at Harvard and other top schools, tell a different tale. I don’t know exactly what percent of Harvard graduates go into the private sector (with or without a clerkship)†¦ and I bet Harvard doesn’t want me to know (See preceding paragraph). From personal experience, though, it’s a lot. It isn’t just those business-corporate types, either. I wrote in my first Law School Consultant blog post about the fact that many law school graduates end up doing something that seems completely different from what those graduates intended to do when they matriculated. That’s definitely true along the public/private line. Both the students who came in wanting to grease the wheels of capitalism and the students who want to derail the trains ended up in corporate law jobs. How did this happen? I’m still not totally sure. It just†¦ happened! It was probably sometime over the 1L summer, when students started to get worried about law firm interviews at the start of 2L year. (Ironically, most Harvard students spend their summers practicing public interest law!) There are a lot of factors pushing students towards early interviewing: summer supervisors who recommend a few years of â€Å"training† on a big law firm’s dime, anxiety about facing the uncertain public-interest job market, even the feeling that â€Å"everyone else is doing it† and â€Å"I may as well try to see what it’s like.† Then comes the wine and dine, the high-paying job offers, the prestige game, and then, when you start to calculate just how much you owe in loans†¦before you know it, everyone’s going to a firm! But, of course, that’s too cynical. (Can you guess which of the aforementioned communities I was a part of?) All law firms do interesting work, that’s important to someone, and is often practiced by excellent lawyers and people. To lump â€Å"big law firms† into one group – as I have done! – is itself impossible: there are firms which do all sorts of work and the lawyers who go there are as diverse in interests and experiences as in any public-service sphere. There’s a lot of important work to be done there too. I know that from having many friends who are in the corporate world. And†¦ the kicker†¦ many lawyers end up doing both! Transitions between public and private spheres seem to be a common factor in many careers, and can go both ways. The public-interested law student who ends up moving to a firm right after graduation might well end up moving back to the nonprofit world a year or two out of law school, while someone who goes right into a public defender or legal-services office could end up at a firm before the five-year reunion. Knowing that makes this vaunted public-private divide seem a little silly after all. So, What Does This Mean for Me? As a law school tutor, I think it’s important for any incoming student to be aware of the pressures that exist in law school, and the way that many students’ interests – or, at least, career preferences/choices – can shift during law school, and to know that job placement statistics don’t always line up with what law schools promote to applicants. The struggle is real. But it shouldn’t actually be a struggle! Or, at least, not the sort of good vs. evil struggle that so many law students seem intent on making the job process out to be. It’s a journey, to be sure. (Mine ended with a math teaching job!) But it’s more complex than it might seem on the surface--or even when you’re in law school. At the onset of the First World War in 1914, England was experiencing a social transformation fueled by years of massive immigration from central Europe and changes prompted by industrial and technological developments. The availability of inexpensive immigrant labor and these developments produced a social environment that permitted a realignment of gender roles and the potential for a revolutionary shift in the role of women in British society. Nicoletta Gullace’s central premise is that there was an appetite for social change in prewar Britain and that cultural instability produced by the war allowed those social forces to coalesce, which Gullace details. The outbreak of the World War neutralized that bias, and horrific reports of German Army behavior reversed the sentiment. These reports detailed the suffering endured in the populated areas of Belgium that were behind the German lines, creating an overwhelming sympathy for the victims of German abuse that transformed the British perception of the war role they needed to play. The War also produced new unprecedented internal social realities, including a million women going to work in British factories. British society was transformed by the ensuing changes and one of the least understood changes, according to Gullace, was the restructuring of the political and economic roles thereafter played by women. There were radical external forces affecting British society as well. Early in World War I, atrocity stories appeared accusing the Germans of inhumane brutality. These reports saturated the British media, fueled by alleged first hand accounts by private citizens, newspaper reports, novels, songs, and even official government investigations. The official Bryce Report concluded that the lurid tales of mutilations and sexual atrocities were in fact occurring. Bryce had relied upon media reports and their original sources as his primary source to reach his conclusions, which were discounted by later historians. Gullace refers to this â€Å"wartime imagery† as at once being â€Å"†¦sentimental and sexual, patriotic and pornographic, effective and subversive (p. 18). This imagery painted the German foes as, â€Å"One vast gang of Jack-the-Rippers,† guilty of sadism such as raping and mutilating naked women and bayoneting babies. Gullace illustrates the social influence of these stories as demonstrated by the 1915 play, â€Å"Rada,† which had a dramatic scene were the women of a household were being raped by German soldiers. A young daughter cries out, â€Å"Oh British! British come! Come quickly British! † Gullace also attributes the exaggerated atrocity stories to the media’s hunger to exploit public passions to sell newspapers, and the government’s compulsion to justify British involvement in another foreign war. Gullace describes the latter circumstance in terms of the pre-war British self-image. It had faltered during the 1900 Boer War when it was discovered that British soldiers had sexually abused imprisoned Boer women and the shame was still carried in the national conscience. Now, in 1914, Gullace posits, the atrocity stories permitted the British public to escape that stigma onto higher moral ground. Gullace also examines the cultural forces that produced the social phenomenon of British women asserting their patriotism at the expense of the men. It became fashionable and socially acceptable for British women to ostracize those men who they believed were avoiding their patriotic duty – which was to join the Army and fight. The sentiment received popular approval and was officially sanctioned. The â€Å"ideal† British man was characterized everywhere as â€Å"Tommy Adkins,† the popular term for a British soldier – who was brave, cheerful, and fair. Gullace cites this image as an outgrowth of the literary works of Rudyard Kipling during the Boer War, idealizing the British soldier. One poet characterized Tommy Adkins as the â€Å"†¦guardian of England’s honor, avenger of her dead, and protector of her children. † (p. 36) The image of Tommy Adkins seized the public’s fancy and deviation from soldierly and patriotic sacrifice was not tolerated. Gullace quotes one newspaper editor’s advice to a female reader who wanted to hold on to her man, as: â€Å"†¦there is much we can do at home. One of the things is to cheer our dear ones, – husbands, sweethearts, fathers, and brothers – and send them off to their calling with brave, noble hearts. † (p. 53) Perhaps the epitome of these passions can be best realized by The British Women’s Union appeal to its members to â€Å"GIVE YOUR SONS. † British women were in the patriotic vanguard, something unique in British. history. The â€Å"White Feather Brigade† and â€Å"The Order of the White Feather† organized women to confront male shirkers and present them with the symbol of cowardice – the white feather. The white feather leagues didn’t last long, but they did presage the organization of feminists into what would emerge as the Suffragette Movement. One of Gullace’s central theses is that the role at home that women played in the war prepared and persuaded the British nation that women were due complete citizenship, and that meant Suffrage. Gullace describes this political acquisition as a â€Å"negotiated right,† and cites previous work by Susan Kingsley Kent, illustrating that until the revolutionary gender changes produced by the war, men and women had inhabited separate social spheres. Taking advantage of the war time opportunity, women had asserted themselves into a full share of patriotic responsibility, they would then subsequently leverage into an equal share of social power. She is curious, but she asks the wrong questions. According to the older members of her neighborhood (like Mrs. Dubose or Aunt Alexandra), she is rampant and the complete opposite of â€Å"ladylike† (101, 136), giving off an air of impertinence. She had asked Atticus many questions that she wass not supposed to ask, yet Atticus answers in a manner that is true, but not too blatant. Adults are always criticizing Scout about how she acts and what she wears. Aunt Alexandra orders that Calpurnia be fired because she is a black woman, seems to be too close to the children and she took Scout and Jem to her church, which is a church mainly for the Negroes (120, 136), which if not already implied, is not idealistic during that set time period. What is at the same time surprising and not, is how ignorant society is toward a certain group or groups of people. In this case, public insensitivity is directed toward the black community. Many who are ostracized do not know what they have done wrong or how they managed to create that type of social barrier between them and the world, but that is what segregation typically is. In To Kill a Mockingbird, there is always the distance between the blacks and whites, within churches, families, and even in court. Despite Atticus’ efforts to prove Tom Robinson innocent (which he obviously was), because of the fact that he is black, the jury announced him to be guilty (211). In the very next chapter, even Scout and Jem see it to be unfair. When Calpurnia decides to take Scout and Jem with her to church, the second the â€Å"white man’s kids† walk in, the rest of the church stare at them because it was not normal to have white people in a black church; it almost never happened (120). It was as if the rest of Maycomb gave no thought to the truth or admit to it. Their insensitivity became an obstacle in whether or not an innocent man should die, with even the killers themselves subconsciously knowing he was innocent Injustice is inevitable and spread throughout every little and large corner of the world. There are social, economic, and racial discriminations, or even separations within schools and families. Fact is, from the very start of prehistoric or even modern civilization, people were grouped separately from animals from plants, plant and animal species from each other, and race from race. Though racism is not as wide today, there is still sexism, disparities in economic and community standards, and more recently introduced, the segregation of gay couples. To Kill a Mockingbird by Harper Lee introduces a small portion of this kind of segregation, and it shows how insensitive the rest of the world is when it comes to following the so-called rules set by society, and history shows that in spite of human intelligence, ignorance of those different from themselves will always lead to injustice.
